The court accepted that there is jurisdiction to order an interim payment of the purchase price where the court has ordered the purchase of shares, and that s.996 of the Companies Act 2006 provides a statutory basis for such jurisdiction; however the powers must be exercised consistently with the Civil Procedure Rules and established principles governing interim relief and leave to appeal.
