The injunction was discharged and the continuation refused because the plaintiff committed deliberate material non-disclosures and misrepresentations in the ex parte application (including failure to disclose prior ex parte rulings, communications and financial encumbrances), and, independently, continuation was unjustified given the surrounding Korean proceedings, absence of demonstrated risk of irreversible dissipation, and sufficient remedies elsewhere; accordingly the court would not re-grant the injunction.
