The court concluded there is a prosecutorial duty to search for and disclose relevant material that may assist the defence even if its precise use is not yet known; balancing fairness and resource burden, the court ordered a defined search of prosecutions meeting specified criteria (individuals over 40, entrants with concealed drugs in luggage, years 2018-2019, evidence of internet fraud) for matching identities, email addresses, telephone numbers and document templates and required production of results by 4:30pm on 8 July 2021.
