The court held the essential features of the applied-for shapes (flat rectangular consoles, two-hand controller forms, and rectangular memory card) are functionally necessary to obtain technical results under TMO s.12(3)(b); those shapes are common in the trade and lack inherent or acquired distinctiveness under TMO ss.9 and 10; accordingly the Registrar's refusals were upheld and Sony's appeals dismissed.
