Where the defendant government does not object to the plaintiff proceeding by originating summons, it is not an abuse of the court's process to permit a constitutional challenge to primary legislation to proceed by originating summons rather than by judicial review under Ord.53; the court will decide such procedural questions on a case by case basis. The court did not decide the substantive question of repeal under s3(2).
