For prosecutions under s.20(7) the draft DPA remains effective because s.20(6)'s exceptions expressly encompass s.20(7) and the definition of unauthorised development in s.1A; therefore the correct comparison date was the day before the draft DPA gazette (11 July 1991) and the Magistrate permissibly inferred the 1991 use from aerial photographs and witness evidence, justifying the finding of material change by significant intensification and upholding the conviction.
