Section 92 of Cap.1 applies to variations that reduce penalties; mandatory disqualification under s41(2) and mandatory retesting under s70(1) are 'penalties' and thus the offender is liable to the penalty as it stood at the time of the offence, requiring application of the mandatory disqualification and retesting provisions in force on the date of the offence.
