Clause 6(5) of the Settlement Agreement prohibits the defendant from applying for or assisting others to apply for registration anywhere of marks that are confusingly similar to the plaintiff's Emblem as judged by ordinary meaning under Hong Kong law; the defendant's PRC registrations breached that clause; clause 6(9) concerns confusion in the Hong Kong market only and does not negate the worldwide prohibition; the injunction as made (including worldwide restraint and withdrawal of the PRC applications) and the costs orders were appropriate and to be upheld.
