Rule 24 applies to applications to reverse or vary a liquidator's adjudication of a proof by virtue of s.264; accordingly a liquidator is not personally liable for the applicant's costs absent bad faith or gross negligence; costs should be paid out of the company's assets and the court will, where appropriate, direct that the applicant's costs be paid in priority to the liquidator's costs.
