Section 3(1)(c) must be given its plain and ordinary meaning: it excludes the debtor from presenting a bankruptcy petition while bound by an approved IVA; allowing a debtor to rely on section 3(1)(b) during the continuation of the IVA would render the words 'other than the debtor' in s3(1)(c) meaningless and defeat the statutory scheme designed to make IVAs a formal alternative to bankruptcy, therefore the debtor's petition is impermissible and must be dismissed.
