Leave to appeal to the Court of Final Appeal was refused because the applicant sought to re-litigate concurrent findings of fact on the meaning of the Words and inducement which did not meet the high threshold for appellate interference; the novel legal questions advanced depended on those factual findings and therefore could not stand; and the "or otherwise" limb did not present exceptional grounds. Costs of the leave application were ordered against the appellant on an indemnity basis with a certificate for two counsel.
