Section 5(3) of the Official Languages Ordinance does not apply to non‑oral proceedings such as pleadings; read in conjunction with the High Court Civil Procedure (Use of Language) Rules r.4, pleadings must be filed in one official language and the court may order translations under r.4(2); accordingly the court ordered English translations of defamatory statements pleaded only in Chinese and reciprocal translations of the Defence.
