The Board failed to demonstrate a real prospect of success on liability because it produced no expert evidence to rebut the statutory presumption that the accident arose out of employment; additionally the Board unduly delayed more than one year after the Default Judgment causing real prejudice and disproportionate further litigation given modest likely damages; accordingly the court refused to set aside the Default Judgment and only permitted the Board to join to contest quantum.
