It was expedient and necessary to appoint Toru Yamashita as new trustee in substitution for the deceased because the deceased was foreign domiciled, died intestate leaving no estate in Hong Kong save the trust share, his heirs did not intend to apply for letters of administration in Hong Kong, and it was inexpedient or impracticable to effect transfer without court assistance; an ex parte appointment was permitted on these facts and the proposed trustee was found fit and proper.
