Because falsified/unauthorised documents had been filed by the 1st defendant and their continuing presence on the Companies Register would cause confusion and potential material damage, the plaintiff satisfied the s42(4) test and removal (rather than mere rectification) was appropriate; accordingly the court ordered removal of the impugned documents and permitted the Registrar to register the plaintiff's Annual Return.
