Because the building was private and access to the common corridor was limited to occupiers and their invitees/licensees who are not 'the public' or a section thereof, the corridor was not a 'public place' under s.2 Public Order Ordinance; accordingly the offence of fighting in a public place under s.25 could not, as a matter of law, have been committed there and the conviction must be quashed.
