On the balance of probabilities the court found Samuel had authority from Tang to enter into the oral agreement on behalf of Houtai HK, Chan performed the contracted services evidenced by shipping documents, the invoice was approved by company staff and remained unpaid, and any payments between Houtai and Crown did not discharge Houtai HK's liability; accordingly judgment was entered for the plaintiff for the invoice amount plus interest and costs.
