On the evidence as a whole the court was satisfied on the balance of probabilities that the 2008 Will was duly executed, the deceased possessed testamentary capacity at the time of execution, and he knew and approved the contents; any alleged suspicious circumstances were dispelled and even if the Second Rule applied the propounder discharged the required affirmative proof; the 2008 Will is therefore propounded in solemn form and admitted to probate.
