Service to the Macau address did not bring notice of the proceedings to the defendant and the default judgment was also entered for too much on the Plaintiff's own pleaded case; therefore the default judgment was irregular and must be set aside. On the evidence the Court set aside the judgment unconditionally and discharged the charging order nisi, granting the defendant leave to defend.
