Leave to appeal was refused because the trial judge’s exercise of discretion on costs was neither wrong in principle nor plainly wrong: the sanctioned payment was for the whole claim and the Plaintiff obtained a judgment far exceeding HK$5,000 so the sanctioned payment did not dictate costs; the Plaintiff reasonably joined the 3rd Defendant given the 2nd Defendant’s change of stance; consequently a Sanderson order against the 2nd Defendant to pay the 4th Defendant’s costs was appropriate and the Costs Order Absolute was upheld.
