The appeals were dismissed and the Master's refusal to join Mr Ng and to make a non-party costs order was affirmed because the Interveners unjustifiably delayed and failed to give prior warning causing real prejudice to Mr Ng, and on the merits there was insufficient basis to make a non-party costs order: the litigation was properly pursued for the company (and its creditors) and there was no allegation or evidence of impropriety or clear personal benefit to Mr Ng sufficient to justify piercing limited liability by way of a discretionary costs order.
