The court discharged the garnishee order nisi because the monies in the joint account were proceeds of the deceased father's estate held for the estate/held on trust; the judgment debtor only had an inchoate beneficiary right (no present beneficial interest) and therefore no present debt existed to which garnishment could attach; additionally, established law precludes attachment of a joint account unless all account holders are judgment debtors.
