The court applied the doctrine of resulting trust: beneficial interests are to be quantified by reference to actual contributions to the purchase price at the time of acquisition. The plaintiff's contribution was limited to the initial HK$500,000; the subsequent monthly payments were found to be familial support, not mortgage contributions. Accordingly the plaintiff held a 30.71% beneficial interest and the defendant 69.29%.
