The conviction was unsafe and unsatisfactory because the appellant was improperly cross-examined about the contents of an unadmitted cautioned statement which could have affected credibility, and the trial judge appears to have failed to distinguish adequately between the cases of co-accuseds (risking conflation of guilt), therefore the Court granted leave to appeal and quashed the conviction.
