The writ was struck out in its entirety because it disclosed no reasonable cause of action, was malicious and an abuse of process, and the claims against the two judges were barred by judicial immunity under Basic Law Article 85; accordingly the strike-out application was granted and an immediate indemnity-based costs order was made subject to limited procedural safeguards.

The claims were struck out and actions dismissed: the Acting Registrar enjoyed absolute judicial immunity for acts performed in the course of judicial functions and the Statement of Claim against him disclosed no reasonable cause of action; alternatively both actions were frivolous, vexatious and an abuse of process because the pleaded facts could not establish misfeasance in public office or unlawful conduct by the clerks; costs awarded on an indemnity basis.

The claims were struck out because, as a matter of law, litigants and their legal representatives owe no duty to adversaries regarding the conduct of litigation and government counsel owe no higher duty; the defendant’s procedural acts (acknowledgement of service, strike out proceedings, and seeking taxation under O 62 rr 10 and 21(4)) were lawful and authorised by the Rules; accordingly the plaintiff’s causes of action disclosed no reasonable prospect of success and were frivolous or vexatious.
