Leave to appeal was granted limited to the complaint that the judge's request for production and inspection of the applicant's telephone may have overstepped and potentially affected fairness; all other grounds, including challenge to the judge's assessment of mens rea and the failing to surrender conviction, were rejected as not reasonably arguable because the trial judge's credibility and factual findings were open on the evidence.
