Where a search warrant is issued to search a solicitor's office and is likely to intrude upon legal professional privilege, the absence of appropriate protective conditions renders the warrant unlawfully issued; however the court will exercise its remedial discretion and where no prejudice has occurred and public interest outweighs claim, relief may be limited to declaration and nominal damages rather than quashing.
