AZAM ADEEL v. DIRECTOR OF IMMIGRATION
- Citation
- [2022] HKCFI 3385
- Court
- Court of First Instance
- Case number
- HCAL1119/2022
Detention was lawful and not unreasonable: statutory detention powers applied, the Secretary/Director intended and actively pursued deportation, an emergency travel document was obtained and a flight scheduled shortly after the decision so there was a sufficient and proximate prospect of removal, and substantial weight properly attached to the applicant's serious criminal record and history of absconding, so continued detention complied with Hardial Singh principles; habeas corpus application dismissed.
