The Preliminary Investigation Committee exceeded its statutory jurisdiction by introducing and acting upon fresh charges of canvassing and fee-sharing that had not been put to the respondent by the Secretary under the Regulations; that procedural irregularity caused substantial unfairness which could not be waived by the respondent's conduct; accordingly the High Court's quashing of the PIC decision and restraint on the Medical Council was correct and the appeal is dismissed.
