The Lands Tribunal, being a statutory body without inherent jurisdiction comparable to the Court of First Instance, lacks clear statutory power to exclude expert evidence at an interlocutory stage; even if such power existed, the proper exercise of discretion was to defer questions of admissibility and scope of the expert's opinion to the trial; accordingly the summons to exclude the reports was dismissed and costs were ordered nisi against the applicant.
