The District Court had no statutory or inherent jurisdiction to admit the respondents to bail pending appeal; section 83Z does not confer such jurisdiction, therefore the Deputy Judge's bail order was made without jurisdiction and must be revoked.

Because s118(1) offences under the Copyright Ordinance (Cap.528) are summary-only and were not indictable, the District Court had no jurisdiction to try those offences when they were transferred without compliance with Magistrates Ordinance s88(1) or without an accompanying indictable offence; transfers were null and void, so the convictions in the six affected appeals were quashed; the two remaining applicants with properly indictable offences under the old Cap.39 were refused leave and dismissed.

The offence was prima facie triable summarily under Interpretation & General Clauses Ordinance s.89(1) and did not fall within any exception permitting trial other than summarily; the purported transfer to the District Court did not validly confer jurisdiction, therefore the District Court lacked jurisdiction to convict and the conviction was quashed and sentence set aside.
