Refusal to extend time: the delay was substantial and inexcusable and the applicant lacked real prospects of success because the proposed PDPO s66 claim was plainly unsustainable — there was no conceivable causal link between the alleged DPP5 contravention and the dismissal or claimed future loss of earnings, and the claim was precluded by prior findings; accordingly extension was refused and the judge's refusal to permit the new amended pleading was upheld.
