The court held that s.8(2) of the Supreme Court Ordinance continues to confer jurisdiction; read with s.77 Cap.I the reference to the Lunacy Acts is read as a reference to the Mental Health Act 1959, and therefore the Supreme Court has jurisdiction to appoint a receiver under s.105 of the Mental Health Act 1959. The judge's interlocutory ruling on jurisdiction is not an appealable matter at this stage and the application for a stay was refused.
