Because the plaintiff succeeded in obtaining the non‑harassment injunction and agreement on access but the matter could and should have been litigated in the District Court, the fair and proportionate order is that the plaintiff recover one half of the costs of the whole action on the District Court scale, taxed under the Legal Aid Regulations.
