The lapse of leave under Order 52 r3(2) does not deprive the court of jurisdiction to grant fresh leave in the same proceedings; the 2nd leave applications filed on 22 July 2015 were fresh and properly constituted; any failure to pay fees (if required) or any non-disclosure was at most an irregularity that could be cured and did not justify setting aside the July Orders; accordingly the respondents' summonses to set aside the July Orders were dismissed and leave was confirmed with directions to fix substantive hearing dates.
