The Court upheld the judge's factual assessment and legal approach: the kidnapping was a very serious, meticulously planned cross‑border offence making an 18‑year starting point appropriate; after the full one‑third guilty plea discount the 12‑year sentence was justified, and the application for leave to appeal against sentence was dismissed.

The court held the deputy judge did not err: Chung's cautioned statements were admissible as voluntary after full consideration of allegations; the directions on accomplice evidence were adequate given the warning and available corroboration; convictions are upheld but, having regard to comparative authorities and the relative roles of the appellants, the sentences were excessive and should be reduced by about one third to 12, 16 and 14 years respectively.

Independent evidence may corroborate accomplice testimony even if the connection to the accused is established by reference to that testimony; corroboration that sufficiently connects one accused cannot be generalized to others; Crown's failure to disclose documents relevant to conditional immunity amounted to a material irregularity under s.83(1)(c) CPO, but where no miscarriage of justice occurred the proviso to s.83(1) permits dismissal of appeals dependent solely on that irregularity.
