The Court held that the tenancy, fingerprint evidence and the applicant's admission of possession of keys and documentary tenancy properly activated the statutory presumptions under DDO ss46–47; once activated the burden lay on the accused to rebut those presumptions on the balance of probabilities; 'trafficking' as defined in the Ordinance includes storage for subsequent disposal; the trial judge's directions were not misleading and the conviction was safe, therefore leave to appeal was dismissed and conviction upheld.
