MING SHIU CHUNG AND OTHERS v. MING SHIU SUM AND OTHERS
- Citation
- MING SHIU CHUNG AND OTHERS v. MING SHIU SUM AND OTHERS
- Court
- Court of Final Appeal
- Case number
- FACV25/2005
Appeal allowed: Court of Appeal erred in concluding the father signed without knowledge in a legally operative sense and in treating lack of knowledge alone as sufficient to invalidate documents; forgery and fraud were not proved with requisite particularity or cogency; absent pleaded and proved vitiating factors (fraud, undue influence, incapacity or unconscionability) the signed instruments stand; therefore the allotment/issuance to appellant is valid and plaintiffs' claim against him dismissed.
