Leave to appeal was granted on two discrete questions: (1) whether the Court's prior statement on animus possidendi in Wong Tak Yue is consistent with J A Pye or should be departed from in favour of Pye; and (2) whether continued, unprotested dealings with the paper owner who believes himself to be landlord negates the requisite animus possidendi despite non-payment of rent. The court held that factual possession must be assessed by reference to exclusive physical control of the property and not by reference to other management activities.
