The Court of Appeal upheld Keith J's refusal of leave: decision 2 did not disclose an arguable case given the real complaint was the language criterion which would be rendered moot if decision 1 succeeded, and changes in para.8 were not judicially reviewable; decision 3 was not covered by the 1995 consent order and was time-barred because the single-step transfer restriction had been in place since at least 1992. The appeal was dismissed and costs ordered for the Secretary.
