The Withdrawal of Funds Summons was dismissed because the application sought substantive partial distribution of estate sale proceeds beyond the scope of the implied liberty to apply in the Consent Order and risked prejudicing absent beneficiaries; the Evidence Summons was dismissed because it was sought out of time without satisfactory explanation and the proper forum to seek leave to file further evidence was the Master; consequently both summonses were dismissed and costs were awarded to the Plaintiffs in the sum of HKD 40,000.
