The court granted the extension of time because, on a multi‑factorial and flexible exercise of discretion, the short delay (8 days), lack of prejudice to the respondent, the special circumstances that REDA sought to challenge binding Court of Appeal authorities at the Court of Final Appeal and the reasonable arguability of the intended appeal at the Court of Final Appeal outweighed the solicitor's mistake; accordingly extension to file the notice of appeal was ordered and costs were ordered nisi against REDA.
