Convictions quashed because the prosecution failed to prove that Apple Daily Printing owed a duty of disclosure to the Corporation (no express or implied term and no special relationship sufficient to create such duty), failed to establish lawful attribution of any such duty or false representations to the individual applicants, and failed to prove falsity and requisite mens rea beyond reasonable doubt; the trial judge erred in holding otherwise.
