The Court held that the Director of Lands, in granting and renewing short-term waivers, was acting in a private/landlord commercial capacity so the decisions were not amenable to public law review; on the merits the Director had considered relevant planning and environmental advice, no positive refusal to terminate was shown, reasons were adequate in context, and the consolidated applications therefore failed and were dismissed.
