Transcript evidence established clear, informed and unequivocal guilty pleas; therefore conviction could not be overturned. Location of cigarettes did not affect the legal basis of conviction. However, the aggregate fines originally imposed (HKD3500) were disproportionate to the appellant's means and circumstances; the appropriate total fines after exercise of sentencing discretion are HKD1,600 (HKD1,000 and HKD600).
