Goldwell was prima facie entitled to the costs order sought because the plaintiff delayed acceptance of the sanctioned payment beyond the last date without seeking leave, incurred avoidable litigation risk by rejecting settlement offers and proceeding to trial where liability was not proved; accordingly it was not unjust to order costs up to 12 October 2010 on a party-and-party basis and costs thereafter on an indemnity basis with enhanced interest at 9% p.a., and to permit payment out of court of the sanctioned payment and accrued interest.
