The appeal was struck out because the subject matter was the refusal to grant an extension of time to appeal a master's striking out order, which is an interlocutory decision requiring leave under Section 14AA; the Plaintiff did not obtain leave, therefore the appeal was incompetent and dismissed.

The Court held that committal proceedings brought under Order 52, though capable of constituting criminal contempt substantively and attracting HKBoR protections, are civil causes or matters for appellate classification and may be heard as civil appeals (CACV). Section 50 applies to interlocutory orders made in committal proceedings, but it does not negate the procedural leave requirement in Section 14AA; Order 59 Rule 21 exempts only committal orders (and their discharge/variation) from leave.
