The judge correctly applied the law and discretion: he was entitled to assess the merits of the interlocutory Mareva injunction at the time of the application and to award costs to the successful applicant on that basis; the injunction had strong merits on the evidence and there was no error of law or misapplication of discretion, therefore the defendants' intended appeal lacked a real prospect of success and leave to appeal was refused.
