Leave to appeal was refused because the appeal was from a bankruptcy order (not the underlying judgment debt) so s.22(1)(a) did not apply; the questions posed were not of great general or public importance under s.22(1)(b); and no miscarriage of justice was established to justify leave.

Leave to appeal to the Court of Final Appeal is refused: the plaintiff's claim for an account of profits is unliquidated and thus does not qualify as of right under s.22(1)(a), and the 'or otherwise' limb under s.22(1)(b) is not satisfied because a retrial does not produce grievous injustice or raise issues of great general or public importance; the defendant's applications for extension and leave are also refused and the retrial ordered by the Court of Appeal remains to proceed.

The Defence was filed and, on the evidence, properly served by post and therefore deemed served under Cap.1 s.8; the applicant failed to prove contrary; the statutory leave criteria under s.22 Cap.484 were not met; accordingly the application for leave to appeal was without merit and dismissed with costs.
