The court found a reasonable excuse for delay because the key incorporation issue only surfaced after the limitation period had expired and the facts (notably company cheques paid to the applicant) made it reasonable to sue the company; accordingly leave under section 14(4) was granted.

The court exercised its discretion under Order 33 rule 4 to refuse the 2nd Respondent's application for a split trial because the liability issue involved disputed facts requiring assessment of witness credibility, the proposed separation would not yield substantial savings in time or costs, the medical issues were straightforward and already supported by reports, and further delay would be prejudicial; accordingly the summons for a preliminary trial/split trial was dismissed and case was directed to proceed to full trial subject to case management directions.
